Introduction and Acceptance of Terms

By accessing or using the website enerband.com (the "Site") and participating in the BurstMarketing™ referral system, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and BEAUTY BAND FAR EAST LIMITED (the "Company").

Product Definition: The "Zero Gravity Skin Coach"

The Enerband is defined as a "Passive Facial Resistance Trainer" and a "Zero Gravity Skin Coach."

Scientific Basis: The device utilizes patented fusion technology (24K Gold Powder fused with medical-grade silicone) to facilitate "Controlled Mechanical Stretching."

Intended Use: The product is designed for facial fitness and skin revitalizing. It is not a medical device intended to diagnose, treat, or cure any disease. Results, such as increased collagen synthesis (up to 30%), are based on clinical research overseen by Prof. Avner Shemer, MD, but may vary between individuals.

The Burstbox™ Reward System

The Site operates a unique, gamified reward mechanism known as BurstMarketing.

Click-Only Mechanics: Unlike traditional affiliate programs, rewards are triggered by "clicks" and visits from friends, not by their actual purchase.

Price Tiers: The standard value of the Enerband is $79/€79. Users may unlock "Ambassador Rewards" (lower prices) through sharing. The lowest possible price is $19/€19.

The 3-Hour Burst Window: To qualify for the 1+1 Gift Reward (two units for the price of one), the user must achieve 5 unique friend-clicks within a 3-hour window starting from the moment of the first share. If the target is met after the 3-hour window, the user is entitled to the minimum price ($19) but not the additional free unit.

Integrity of Referrals: Clicks must be from unique, real human users. The Company uses proprietary algorithms to detect bot activity, self-referrals, or "click farms." Fraudulent activity will result in the immediate voiding of all rewards. The Company has a legitimate interest (GDPR Art. 6(1)(f)) in preventing fraud and protecting the integrity of the Burstbox reward system. The technical means used for fraud detection (including browser fingerprinting) are described in our Privacy Policy.

Payments, Shipping, and Delivery

Shipping Options: Standard mail shipping is $5 and is delivered within 30 days of order confirmation. Express mail (up to 24 hours) is $25. If delivery is delayed beyond the standard window, the customer may cancel the order for a full refund.

Taxes: International orders may be subject to local import duties and taxes, which are the responsibility of the recipient.

Returns and "Results-Based" Refund Policy

We offer a 45-day full refund guarantee. This policy applies only to customers who purchased the Enerband at full price and can demonstrate that they used the device as instructed without seeing the promised "Zero Gravity" effects. To initiate a return, contact contact@enerband.com.

Right of Withdrawal (EU Consumers Only)

If you are a consumer resident in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party indicated by you, other than the carrier) take physical possession of the goods.

To exercise this right, you must inform us - BEAUTY BAND FAR EAST LIMITED, contact@enerband.com - of your decision by an unequivocal statement (letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.

Effects of withdrawal: We will reimburse all payments received from you, including the costs of delivery (except for supplementary costs arising from your choice of a non-standard delivery option). Reimbursement will be made within 14 days of receiving the returned goods or proof of return. You will bear the direct cost of returning the goods.

This 14-day statutory right is separate from and in addition to the 45-day results-based refund described in Section 5.

User Conduct and Referral Etiquette

Users are prohibited from "spamming" their referral links in a manner that violates the terms of third-party platforms (e.g., Facebook, WhatsApp, Instagram). Links should be shared based on 100% Trust - between friends and family.

Intellectual Property

The Enerband design, the Burstbox™ interface, and all scientific content provided by Prof. Shemer are protected by international patents and copyrights. Any unauthorized reproduction is strictly prohibited.

Limitation of Liability and Jurisdiction

The Company shall not be liable for any indirect or consequential damages arising from the use of the product. These terms are governed by the laws of Hong Kong.

Notwithstanding the foregoing, consumers resident in the European Union retain the protections afforded by the mandatory consumer protection laws of their country of residence (Rome I Regulation Art. 6).

Online Dispute Resolution (EU Consumers)

The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Consumers may use this platform to resolve disputes arising from online purchases. The Company is not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Severability

If any provision of these Terms is held to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. The Company will replace such provisions with provisions that are enforceable and that have, to the extent possible, the same legal and economic effect as the unenforceable provision.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 30 days before they take effect. Continued use of the Site after the effective date constitutes acceptance of the updated Terms.
